TERMS AND CONDITIONS

The PetWorking, a company operated by PETS GANG LLC, through its website offers online and in-person events, valuable content, classifieds space, products and services, which can be accessed by Members according to their chosen categories.

By registering as a Member of The PetWorking, you agree to the terms and conditions described below.

The Member should carefully read the Terms and Conditions each time he/she intends to access the website www.thepetworking.com or the Member area because this document may be subject to change without prior notice.

The member will have the benefits corresponding to the chosen membership and these are active from the date of payment.

MEMBERSHIPS

Memberships are personal and non-transferable.

Your username is the email address you have registered with us and where you will receive links and login validation for online events.

You can make adjustments to your account profile to update your email or contact information.

The PetWorking reserves the right of admission.

Memberships start from the date of purchase in advance for 30 days. Automatic payment option is enabled so the membership will be charged monthly to the payment method provided. For registration and payment as a VIP member, you must provide a current, valid and accepted form of payment.

Each member will have a unique, personal and non-transferable account. In this account, the user must provide his or her personal data. Once registered, the member will have access to the Members area. The member must maintain the confidentiality of his/her user name and password, committing him/herself not to provide these data to third parties. In this sense, the member is solely responsible for his or her access credentials.

If the member detects that his/her account has been compromised or impersonated, he/she should immediately contact us at info@thepetworking.com so that appropriate measures can be taken.

You represent that you are of the legal age of consent under the rules governing your place of residence, and you agree that you are legally competent to enter into this agreement.

All information provided by the Member to this Platform must be true, current and complete.

The Attendee or Member agrees that he/she must have the appropriate technical requirements (Hardware, Software, Internet Connection, etc.) for the proper functioning of the website and for the connections to the online events.

VIP members as well as Sponsors, accept that the information provided by their company will be uploaded to our Members area - Directory to be shared with other members. They also agree to the use of their logo and branding for publication on the platform and on our social networks. And by sending us the information of their coupons, promotions and advertisements, they authorize their publication on our platform, networks and newsletter sent to our database.

RESTRICTIONS

It is strictly prohibited for members to use the www.thepetworking.com website, our groups and social networks and our online transmissions or face-to-face events for: (a) Unlawful purposes; (b) Instigate or solicit others to perform or participate in unlawful acts or those for which they are not authorized by the law of their place of domicile; (c) Violate any law within the user's jurisdiction; (d) Infringe or violate the intellectual property right, trademarks, copyright of The PetWorking or third parties. (e) Harass, abuse, insult, harm, defame, slander, libel, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, disability or any other basis; (f) Submit false or misleading information; (g) Transmit or upload viruses or any other malicious code that is or may be used in any way that could compromise the functionality or operation of the website or The PetWorking's other platforms, service platform, or any other website or the Internet; (h) Collect or track other people's personal information; (i) Generate spam, phish, pharm, pretext, spider, crawl or scrape; (j) Any other illegal, immoral or obscene purpose; (k) Send unsolicited emails and/or advertise or promote goods and services outside the spaces assigned according to the type of membership purchased; (l) Breach or circumvent the security measures of the website or any other related website and in general any site on the Internet.

The Petworking reserves the right to suspend or cancel the Member's account and/or the use of the service through the platform and/or the access to the website or any other related website, in case of any of the prohibited uses described above.

THIRD PARTY LINKS

The website may include and link to material, content, products and services from third parties such as business owners, entrepreneurs, academic content, sponsors and foundations. The PetWorking is not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third party material included on our website. The PetWorking is not responsible for any damages or injury related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with third party websites. Members must carefully review the policies and practices of third parties and make sure that he or she understands them before engaging in any transaction. Members acknowledge that any complaints, claims, concerns or questions regarding third party products should be directed directly to such third parties.

DISCLAIMER OF LIABILITY FOR RESULTS

Members attend in-person or virtual events at their sole and complete risk, without any guarantee by The PetWorking on sales results, negotiations or contacts. Members understand that they may encounter other attendees or sponsors with brands, companies or ventures that compete with their products or services.
Under no circumstances shall The PetWorking be liable to any member for any indirect, incidental, consequential, special, punitive or exemplary damages, including, but not limited to, loss of business, revenue, profits, use, data or other economic advantage. Members shall be solely responsible for any agreement, alliance, negotiation, contact or marketing they choose to enter into with other members or attendees.

INDEMNITY

Members agree to hold harmless and indemnify The PetWorking, its matrices, subsidiaries, affiliates, partners, officers, directors, agents, contractors, service providers, subcontractors, suppliers and employees from and against any claims, losses, actions, demands, liabilities, costs or expenses (including attorneys' fees) arising out of the following: (a) Member's access to or use of the Platform; (b) any action taken under Member's account, whether by Member or any other person; (c) Member's violation of any of the provisions of this Agreement; (d) Member's failure to deliver, perform, perform, quality, promptly or efficiently the services provided through this Platform; (e) Member's violation of any third party rights, including without limitation any proprietary, intellectual property, copyright, publicity, confidentiality or privacy rights. This indemnity provision shall survive termination or expiration of this Agreement.

PAYMENT POLICIES

Upon acquiring the membership, the member may choose to be automatically sent, to the email address registered, the invoice corresponding to each monthly charge based on the data provided.

Payment on The PetWorking platform will be made through the Stripe electronic payment platform. At the moment the membership purchase is made, the buyer will be sent to a secure payment gateway provided by the Stripe platform, where he/she will provide the required credit card details of the cardholder.

The PetWorking does not store any bank details of its users or members, since the process is carried out on the secure online payment platform. In the event that the payment cannot be made satisfactorily, due to expiration, lack of funds, if the payment method information is not modified or if the account is cancelled,

The PetWorking may suspend access until the corresponding payment is obtained. The member warrants that by using the online payment system he/she is authorized to use the credit or debit card for the payment he/she is making. The PetWorking is not responsible if payment is declined or denied by the card issuer for any reason. If the card issuer declines payment, The PetWorking is under no obligation to inform the cardholder or card user of this fact.

Membership payments are NON-refundable and no refund or credit will be given for unused or partially used membership periods. If for any reason the member did not attend or connect to any of the PetWorkings Online or did not make use of the other resources, The PetWorking disclaims any liability or full or partial refunds.

The Member may decide to unsubscribe from receiving informational and promotional emails without any reduction of the monthly membership fee. All monies received will be refunded if and only if The PetWorking has force majeure problems that prevent it from carrying out its activities. In case of technical or connection problems of any PetWorking Online, The PetWorking may offer the postponement of the corresponding date as a solution.

REGULATIONS

Members accept the present Terms and Conditions as well as the official Regulations for the attendance to face-to-face and Online events, for the publication of Ads and Promos, for the participation in the private Facebook groups and for the participation of the foundations. These regulations are available on this same web platform www.thepetworking.com. The website reserves the right to suspend and/or deactivate and/or delete the account of the member who does not make good use of this platform or who does not comply with these
terms and conditions.

These Terms and Conditions, as well as the respective Privacy policies posted by us on this website constitute the agreement between Attendees and Members and us and govern the use of this platform and supersede any prior agreements, communications and proposals, verbal or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).

This agreement and its Terms and Conditions shall be governed by and construed in accordance with the laws of the United States of America. Any action or claim arising in connection with this agreement, regardless of the place of domicile or residence of the user shall be subject to the Jurisdiction and Jurisdiction of the Judges and Courts of the Superior Court of Justice of Miami, United States of America. You expressly consent to the jurisdiction of such courts and waive any challenge or exception based on domicile or nationality.
